“Red Flag Law” Extreme Risk Protection Order (ERPO) Act 38 of 2023
This is a FREE effective tool we can all use to help prevent gun violence.
They can help prevent a person in crisis from accessing firearms, thereby reducing the risk of suicide, mass shootings, domestic violence, or other acts of violence.
An ERPO is a civil, non-criminal, TEMPORARY removal of and restriction to purchase new firearms of an induvial that: “can reasonably be expected within the near future to intentionally or unintentionally seriously physically injure themselves or another individual by possessing a firearm, and has engaged in an act or acts or made significant threats that are substantially supportive of the expectation”
Who can file?
A spouse, former spouse, family member, guardian, law enforcement officer or healthcare provider.
If you feel an ERPO has been filed against you falsely it can be appealed before the final hearing.
It is FREE to file and to appeal an ERPO.
